Terms and Conditions

Use of ExoticAuction App constitutes acceptance of our Terms and Conditions. User understands and accepts that Terms and Conditions may change at any time and without notice. User is bound to current terms and conditions regardless of acceptance date.

AUCTIONEER: ExoticAuction will also be referred to as “Auctioneer”.

OWNERSHIP/TITLE: Ownership/Title of each item changes hands at either: a) customer pick-up of animal or b) delivery of animal to customer ranch by WildLife Partners, LLC on behalf of ExoticAuction. High bidder agrees that they are contractually obligated to pay for the listing immediately upon auction completion.

USER VERIFICATION: ExoticAuction will verify all bidders. If complete verification is not possible, ExoticAuction will reject the registration, and bidding activity will not be possible. All registration information provided to ExoticAuction is required to be accurate, current and complete. Bidders must be at least 18 years old. Bidder agrees not to interfere with any activity being conducted on and/or during a listing.

CONTRACTUAL AGREEMENT: User agrees that if they are high bidder, or purchase any listing, that they have entered a contractual agreement to pay for the listing using the appropriate method of payment described in these terms. This contract is binding. Only ExoticAuction has the right to terminate any contract, user or agreement with user. This can be done at any time, without notice, at the auctioneer’s discretion. Auctioneer reserves the right to terminate bidder registration, restrict access and impose use limits without notice.

BIDDING: Placing a bid or purchasing a listing creates a binding contract between the user and the seller. Bids and purchases may only be retracted by ExoticAuction. Placing a bid obligates user to pay for animals, should they win the auction, at the bid price plus any applicable fees and taxes. If a bid is placed in error, ExoticAuction must be contacted not less than 8 hours before the listing closes. Bidder may be required to send written confirmation stating their intended bid. Bidders may use ExoticAuction. proxy bidding system. Should any user bid on and win their own listing, a 10% fee on the final/winning bid will be assessed.

AUCTION ITEMS: A 10%  fee will be assessed on all consigned animals listed from WLP barn. A 7% consignment fee applies to animals listed from the seller’s facility. Consignments listed with set reserve amounts not met will be charged 10% of the highest bid. Payments made to Consignors via wire will incur a $15.00 processing fee.

Consigner of items for sale verifies that they own and/or have the legal right to sell items listed on ExoticAuction. All parties agree to not hold ExoticAuction liable for items sold by a consigner without the legal right to sell. Seller shall owe seller’s fee to ExoticAuction regardless of whether the animal purchased can be delivered to customer. Animals consigned and sold are to be captured and delivered within 14 days of auction close, unless other arrangements have been agreed between buyer and seller. Once a consigned lot auction has begun, seller agrees to not close or end auction early, unless with the express consent of Auctioneer. All consignments not paid for as described above may be sold to the next highest bidder or relisted.

The buyer of an item on this app will be responsible for paying sales tax, if applicable. All sales are subject to State Sales Tax laws. All sales will be charged a sales tax unless the buyer can provide their agriculture tax exemption number for items that qualify for exemption, or the items being sold are exempt from any state sales tax. The sales tax to be charged on a taxable item will be determined by the state in which the item is sold and will reflect that state’s sales tax rate. Seller will be responsible for submitting any sales tax collected by ExoticAuction to the applicable state. ExoticAuction will collect a seller’s fee, along with any other fees incurred by the seller, from the total winning bid amount before payment is made to the seller.

PAYMENT: Buyer agrees to remit payment immediately after an auction is considered successfully closed. Payments may be made via cash, wire transfer, direct deposit, bank certified check, or ACH, unless otherwise noted in listing to WildLife Partners, LLC. All purchases paid for with a credit/debit card will be assessed a 3% processing fee based on the purchase price of the animal(s). Pick-up/Delivery may not be scheduled until payment is complete. If Buyer does not pay within 24 hours of auction close, Buyer will be notified they are in preliminary default and have 48 hours to remit payment. Should payment not be remitted within 72 hours, Buyer will be in default. Buyers in default will be subject to pay three (3) times winning bid price plus Legal fees required by ExoticAuction to collect debt. Once 72 hours have passed, item will be relisted for sale on ExoticAuction.

INVOICE: Buyer will receive an electronic invoice at the conclusion of a listing sent to the user’s email address on file. Additionally, the invoice will be available in the user’s profile on ExoticAuction.   
LISTING REQUIREMENTS: ExoticAuction reserves to right to edit any listing. Auctioneer reserves the right to suspend, change or terminate a listing. Auctioneer’s decision about any listing is final.

SELLER AGREEMENT: Seller agrees that animals listed on ExoticAuction app will be at the liability of the seller until warranty (described below) has expired. Seller agrees to pay 10% commission on all animals sold on ExoticAuction. Seller agrees to pay a $20 listing fee per lot that sells. Should any user bid on and win their own listing, a 10% fee on the final/winning bid will be assessed.

WARRANTY: ExoticAuction offers a 1-week (7 calendar days) guarantee on all animals starting at the close of sale. Consigned animals offered on ExoticAuction must also provide a 1-week warranty. See below in these terms for an explanation of the WildLife Partners warranty policy.

REMOVAL/DELIVERY: Purchased animals may remain on the sale premises until pick-up/delivery is arranged.

STALL FEES: Pick up or delivery arrangements must be made within 24 hours of lot closing. Failure to comply will result in a $100 fee per stall, with an additional $10/day per animal. Stall fees must be paid by the time of delivery/pick up. Stall fees apply to consignment animals that do not meet the set reserve amount. Animals must be picked up within 24 hours of lot closing.  ExoticAuction will arrange delivery of animals from WildLife Partners, LLC facilities to destinations within 300 miles, for $4.00 per loaded mile. Buyers requesting ExoticAuction to arrange delivery from a non-WildLife Partners location will sign a Waiver of Liability. This waiver will remain in effect indefinitely. Buyer is solely responsible for knowing and adhering to state entry requirements before bidding on any item listed on ExoticAuction. Stall fees will be waived if Wildlife Partners cannot deliver on the agreed-upon date.

RESALE: If a seller brings an item for sale to the ExoticAuction barn (WildLife Partners, LLC facility) and the item does not sell for any reason, the seller has the option to list the item for a two-day auction with no reserve, or the seller can pick the item up and pay any feed and/or stall fees. This only applies to animals that are in the ExoticAuction facility or any other designated WildLife Partners’ facility.

REFUNDS/CREDITS: Refund/Credit claims shall be submitted in writing to ExoticAuction within 24 hours after a listing closes. User agrees that all decisions regarding refunds/claims made by ExoticAuction are final and not contestable by user.

ExoticAuction GUARANTEE: As a subsidiary of WildLife Partners, LLC, animals owned and delivered by WildLife Partners are subject to WildLife Partner’s animal guarantee. See www.wildlifepartners.com more details. Consigned items on ExoticAuction also offer a 1-week guarantee.

PRIVACY: Information collected on ExoticAuction app users is only used for conducting business between users and ExoticAuction.

HOLD HARMLESS: ExoticAuction will not be held responsible for any interruption in service, errors, and/or omissions, caused by any means whatsoever. Therefore, ExoticAuction cannot guarantee continual, uninterrupted or error free service as our app could be interfered with by means out of our control. User acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. The Auctioneer may void any sale, temporarily suspend bidding, re-start the bidding after a malfunction and re-sell any items that were affected by any malfunction. The decision of the Auctioneer is final.

INDEMNIFICATION: User agrees to indemnify, defend and hold Auctioneer and Seller(s) harmless for any personal injury to himself or his agents, any property damage incurred during property removal, any and all claims, losses, damages, liabilities, judgments, fees and expenses related thereto, in connection with any claims arising out of, based upon, or resulting from any breach or violation by user of this Contract or any use by user of the app or as a result of a dispute with another user.

AGENT ONLY: ExoticAuction is acting as agent for the Seller/Owner only and is not responsible for statements made by other parties, accidents, injury, or death of property. 

TERMS & CONDITIONS FOR EXPORTATION OF ANIMALS OUTSIDE TEXAS

1. Buyer Responsibility for Transportation and Compliance

All responsibilities for the transportation, permitting, and testing required for the legal transfer of animals outside the state of Texas rest solely with the buyer. The seller shall not be held liable for any failure of the buyer to comply with federal, state, or local regulations, including, but not limited to, those pertaining to wildlife, health, and transportation.  This includes states in between Texas and final destination.

2. Permitting and Legal Compliance

The buyer is solely responsible for obtaining all necessary permits, certificates, or licenses required to legally transport (all states in between Texas and final destination) and house animals in their destination state. This includes any federal, state, or local requirements for the importation and possession of exotic animals.

3. Health Testing and Quarantine Requirements

The buyer must ensure that all health testing and quarantine protocols are met as required by the destination state and any state in between. This includes any health clearances, veterinary certifications, or quarantine processes needed for the importation of animals. The seller does not conduct health testing or provide health certifications for exportation beyond the state of Texas.

4. Transportation Arrangements

All arrangements for the safe and legal transport of animals are the buyer’s responsibility. The buyer must ensure that the chosen transportation method meets all legal requirements and provides for the humane handling and care of the animal during transit.

5. Liability Waiver

By completing the purchase, the buyer agrees to release the seller from any and all liability associated with the transportation, permitting, testing, and legal compliance for animals exported outside Texas. The seller is not liable for any losses, delays, damages, or legal penalties resulting from the buyer’s actions or omissions.

6. Acknowledgment of Risk and Responsibility

By purchasing an animal for exportation outside Texas, the buyer acknowledges and accepts all risks and responsibilities involved. The buyer certifies that they understand and agree to these terms, and that they have taken all necessary steps to ensure legal compliance for the transport and possession of the animal in the destination state.

7. Non-Refundable Purchases

All sales are final. Due to the complexity and responsibility associated with exotic animal exportation, no refunds will be provided once a purchase is completed. Terms and Conditions for Exportation of Animals Outside Texas.

8. Payment

All invoices must be paid in full before any animals are tested. If testing is to be conducted at our facility, there will be a daily stall charged and that payment will be collected up front.
